Why can't he just both? Schedules can be worked out and the Gus film would be a short shoot most likely. He won't be need for the whole time to play Lex Luthor either.

If the role is Luthor, I assume that they want someone who's willing to do more than one film. I really don't see Phoenix committing to two or three superhero films.
