If they fold and go under… it could be disastrous for the project.

They really couldn't move fwd until the fate of MGM was figured out and that's still very much up in the air (pretty much the reason why Bond 23 was indefinitely delayed).

Del Toro, made a four picture deal with Universal that would tie him up until 2017 and if he spends another 4-6 years on the two Hobbit films, everythign he's obligated to do is gonna backslide. He simply had to bail.

With Jackson as co-writer and producer it's not like the Hobbit is ever going to escape the long shadow of the LOTR trilogy (nor does it really need to), so I reckon they never really needed a director with as unique a visual take as Del Toro. (I just love that cuddly bastard, and am jonesing for some more of that Pan's Labyrinth mojo)
