Foley's death is one of the (few/most) cheesiest scenes in the film. Honestly, it screams MPAA approval. I think blatantly driving over Foley was clearly the intention before hand and *you know who* doesn't actually say Foley's explicitly when ordering to kill "them all". So I think we're looking at one of those odd random "you can't do this in a PG-13 movie" interventions… In any case, someone on the editing floor wanted a less violent death for Foley. I think it's too bad, I was looking forward to that scene and instead the new scene is just so bad, to zoom in like that "Hey kids, look at this tragic victim of this epic showdown." Ugh. Oh well. TDKR had more of those odd things. (Some prologue re-dub lines for example.)

I know exactly how you feel, MModz. I walked out of the theater going "Oh, SHIT, man, I can't believe they killed Foley! How can you do a Batman movie where you kill FOLEY?!" A passerby was so pissed off that I ruined the movie for him like that that he beat me into unconsciousness. I woke up with such severe brain damage that Blake was my favorite character.

Nolan probably didn't want to give Foley a more detailed death than Bane. That would have been weird.
